1. The Société Anonyme under the corporate name “modulus Telecommunications and Informatics S.A.” and the distinctive title “modulus S.A.” (hereinafter referred to as the “Company” or “modulus”), having its registered office at 311 Mesogeion Avenue, Chalandri, Attica (Tax Identification Number: 998301677, Tax Office: KEFODE Attikis), has created the website modulus.gr (hereinafter the “Website” or “Site”), offering information and services to its visitors/users (hereinafter referred to as the “users” or simply “you”), pursuant to operating license no. 08-388 issued by the Hellenic Telecommunications and Post Commission (EETT). Use of the Website and the services provided through it requires the unconditional acceptance of these General Terms of Use (hereinafter the “General Terms of Use”) by users. Furthermore, use of any services of any kind provided by modulus additionally requires the unconditional acceptance of the specific terms under which such services are offered. The visitor/user of the Website acknowledges and agrees that with each visit to and/or use of the Website, they shall apply and be bound by these General Terms of Use as described below. In the event of disagreement with one or more of these terms, the visitor/user must refrain from any visit to and/or use of the Website.

2. Μodulus S.A. reserves the right to amend these General Terms of Use, part or all of the content of the Website, as well as part or all of the external appearance (interface), structure or configuration of the Website, and its technical specifications, while providing notice of such changes for a reasonable period of time during users’ visits to the Website. While navigating the modulus.gr website, you are obliged to stay informed about any amendments. Any such amendments shall be effective as of the date of their posting on this Website. In the event that the user continues to use the Website after the announcement of amendments, it shall be presumed that the user has accepted such amendments.

3. In the event that any service is governed by more specific terms of use, such terms shall be considered as forming a unified whole with these General Terms of Use. In case of any conflict between them, the more specific terms of use for each service shall prevail. The potential invalidity of any of these General Terms of Use shall not affect the validity of the remaining terms. The Company’s failure to exercise any of its rights under these General Terms of Use shall not constitute a waiver of such rights.

The following General Terms of Use and the specific terms of use for each service are accessible both during your navigation of the website prior to the registration process for the provided services, and thereafter, as they are set out in detail in the footer of the Website. Modulus S.A. considers that all users have read and agree to these General Terms of Use. Users have the right to withdraw their consent at any time. Such withdrawal of consent shall automatically result in the termination of the user’s right to use the relevant service.

5. Minors are prohibited from registering for and using the website and the services of modulus.gr, which by law are intended exclusively for adults. In the event that, nevertheless, minors voluntarily visit the website or use services that may be considered inappropriate, modulus S.A. shall bear no responsibility whatsoever.

6. The website modulus.gr is used by users under the General Terms of Use in force at any given time, without the possibility of modifications or other interventions in these terms by the users. Μodulus S.A., acting in good faith, in accordance with the principles of Art and Science, and in line with fair commercial practices, provides a secure environment for the use of the modulus.gr website, as well as accurate, complete, valid, reliable and up-to-date information.  In any case, however, you acknowledge and accept that modulus S.A., given the nature of the services provided, may not be in a position to exercise control over all of the content and the security of the modulus.gr website and its services. For this reason, the Website is provided “as is” and modulus S.A. makes no commitment, provides no warranty, and assumes no responsibility with regard to its security or content. Accordingly, you are required to assess the content and you bear sole responsibility for any risk, threat, or damage that may result from the use of the Website or its content, including your decision to rely on the accuracy, completeness, validity, or usefulness of any content on the modulus.gr website.

7. The User agrees, to the extent permitted by applicable law, to indemnify and hold the Company harmless from any damage or expense, including attorneys’ fees, arising from or in any way related to the use of the Website or the breach of these Terms.

8. The Website provides referrals through links (hyperlinks or advertising banners) to other websites, the providers of which bear full civil and criminal responsibility for the security, lawfulness, and validity of the content of their websites and services, with modulus S.A. bearing no liability or responsibility whatsoever, including, indicatively, liability concerning intellectual and industrial property rights or any other third-party rights. Accordingly, users are obliged to comply with the terms of use of such websites and to address any issue arising from their visit to and/or use of those websites directly to their respective providers.

9. Access Credentials / Passwords
 Browsing the Website does not require registration. However, access to certain services or connection to specific pages may require that modulus S.A. requests your personal details for the purpose of granting a relevant access password. Such details must always be true, accurate, valid, and complete.

10. Users are responsible for all actions carried out using their access password and are obliged to immediately notify modulus S.A. of any unauthorized use thereof and of any (including potential) security breach. Such credentials shall not be disclosed by modulus S.A. to third parties. modulus S.A. shall not be liable for any damage or loss that may result from the unauthorized or unlawful use of the access password by third parties due to its disclosure or for any other reason, and reserves the right to claim compensation from the user in the event it suffers any kind of damage from the unauthorized or unlawful use of the access password.

11. Μodulus S.A. shall be entitled at any time to refuse to grant an access password, to cancel a password already granted, or to terminate the provision of such services to the user and to refuse any current or future use of the modulus.gr website, in the event of a breach of the Terms and Conditions of Use. You are required to exercise the necessary prudence and care in safeguarding your access passwords and not to disclose them to any third party. The passwords provided by modulus S.A. are intended strictly for personal use, and the responsibility for any loss or theft of such passwords lies exclusively with the user to whom they are granted. All activities corresponding to the user’s name and password shall be presumed to have been carried out by the user, who bears full responsibility for the content and use of the services they access.

12. Subscription to the newsletter. Your subscription to our Company's newsletter is at your own initiative and is not a mandatory procedure for the provision of our services, including your simple browsing of our Website. Your subscription to our Company’s newsletter is completed by entering your email address in the designated field on our website and following the double opt-in procedure. By completing your subscription, you provide your explicit consent for our Company to send you informational and promotional material regarding its products and services, as well as related advertising messages. For information on how your personal data is protected in this context, please consult our Privacy Policy. The Company shall not be held liable if newsletters are not delivered to their intended recipients, although every reasonable effort is made in cooperation with Internet Service Providers (ISPs) to ensure proper delivery. Newsletters may end up in your spam folder, so we kindly ask that you check regularly to ensure they are not stored there. If you no longer wish to receive newsletters, or if you wish to unsubscribe entirely from the Company’s news distribution system, you may notify us via the contact form available on the Website or by using the unsubscribe link included in every newsletter you receive from us.

13. User Obligations. Without prejudice to any third-party rights, all original content of the modulus.gr website  including, indicatively, registered and protected trademarks, trade names and company names, distinctive signs, photographs, designs, texts and, in general, files, constitutes the intellectual and industrial property of modulus S.A., the rightful owner thereof, and is protected by the relevant legislative provisions. The above content may not, in whole or in part, be sold, copied, modified, reproduced, retransmitted, transmitted, circulated, or distributed in any manner by any user without prior written permission.

14.  The products and/or services of third parties appearing on the modulus.gr website are the intellectual and industrial property of the Company or of third parties, who bear responsibility for the content and services and/or products. Users accept, agree, acknowledge and undertake to use the website in a lawful and appropriate manner. Therefore, users agree, indicatively and not restrictively, that:
- They shall not cause harm to minors, they shall not transmit, distribute, or in any way promote content that is unlawful or contrary to public morals, including but not limited to unlawfully obtained material, intercepted communications, terrorist content, and child pornography.
- They shall not transmit or gain access to content that:
 i) infringes upon third-party rights (e.g., intellectual and industrial property rights); 
ii) violates fundamental human rights recognized under national law and the European Convention on Human Rights and Fundamental Freedoms (e.g., right to privacy, prohibition of discrimination on any grounds including gender, race, color, language, religion, political or other opinion, national or social origin);
 iii) is contrary to applicable law, public morals, or good commercial practices;
 iv) violates in any way the privacy and individual or social rights of third parties.
- They shall not mislead any party as to the origin of the Website’s content, damage the reputation of modulus S.A. in any way, hinder other users’ access to modulus.gr, or bypass any identity verification processes implemented by modulus S.A.
- They shall not install or promote, in any manner, any form of unsolicited or unauthorized advertising or electronic communications (spam), chain letters, pyramid schemes, or any other form of unwanted promotional content, nor install or promote advertisements without the prior written consent of modulus S.A..
- They shall not install, promote, or make available any content containing viruses or any other type of malicious code, files, or programs designed to interrupt, destroy, or limit the functionality of any software or telecommunications equipment, or otherwise obstruct other users from utilizing the Website modulus.gr.
- They shall not disclose their own or third parties’ personal information, including personal data of users or third parties, whether in real-time communications (such as chats, message boards) or through any service on the modulus.gr Website that enables communication among more than two users;
- They shall not assign, resell, sublease, or otherwise transfer their rights or obligations under these Terms and Conditions, in whole or in part.
- They shall not use the service for the purpose of notifying or communicating with third parties or competent authorities in emergency situations, as the success or timely delivery of a call or message is not guaranteed. Μodulus S.A. shall bear no responsibility for any failed call or data transmission, nor for the improper completion of any such communication.
- They shall use the system in accordance with the principles of privacy and confidentiality of communications and good manners. Modulus is not responsible for malicious calls or offensive, illegal, or immoral content of telephone calls, which it has no control over and cannot modify. However, in the event of complaints, Modulus S.A. may immediately suspend the provision of services until the matter is resolved.
-  They shall comply with all applicable local, national, European, and international legislation governing the services provided through the Website.
- Users shall transmit and/or process data in accordance with the principles of lawfulness, transparency, and accuracy of the information they generate. In all cases, any processing activities shall fully comply with the General Data Protection Regulation of the European Union (Regulation (EU) 2016/679). Users shall respect the rights of data subjects under the Regulation and shall ensure that all processing activities are based either on valid consent, where required, or on another lawful basis that demonstrates the legitimacy of the processing.

15 .In any case of illegal or contrary use of the website modulus.gr, visitors-users are obliged to compensate modulus S.A. for any direct or indirect positive and consequential damage. Failure by modulus S.A. to exercise its rights under these Terms and Conditions of Use does not imply a waiver of such rights.

16. Website Availability & Network Security. 
The Company reserves the right to modify and/or suspend, temporarily or permanently, all or part of the Website for reasons of maintenance, upgrade, or for any other reason, with or without prior notice to users. The Company makes reasonable efforts to maintain and ensure the availability of the Website; however, it does not guarantee uninterrupted access, as availability may be affected by users’ equipment, other communication networks, the high volume of simultaneous users, or other causes. Users acknowledge and accept that the Company shall not be held liable for any potential damage arising from the use of or inability to access the Website, the discontinuation of all or part of the Website, delays, failures in delivery, interruptions, poor quality of service reception, loss of content, or the presence of any kind of errors. Therefore, each user is responsible for ensuring their own protection (e.g., by using antivirus software, virus scanners, or other protection systems) prior to using the Website or storing any information, software, or content from the Website on their terminal devices.

17. Force Majeure. The Company shall bear no responsibility for any failure or inability to comply with these General Terms of Use when such failure or inability is due to force majeure or any other cause beyond the Company’s control or sphere of influence, including but not limited to war, strikes, accidents, earthquakes, floods, fires, storms, or other natural phenomena, acts of terrorism, sabotage, governmental prohibitions, actions of Greek, EU or other authorities, trade embargoes, interruptions or malfunctions in the public telecommunications network or in third-party electronic networks (especially if used by the Subscriber to access the Company’s service), court decisions, prosecutorial orders, provision of the service at a different location than that declared by the Subscriber as their permanent address, replacement of copper network infrastructure, equipment failures, malfunctions, or misconfigurations, and improper use or configuration of the Subscriber’s terminal equipment, etc.

18. Governing Law/Jurisdiction. These General Terms of Use, including any amendments thereto, shall be governed by and construed in accordance with Greek law. Any dispute arising out of or in connection with the present agreement shall fall under the exclusive jurisdiction of the competent courts of Athens, Greece.

19. Confidentiality of Communications -  Protection of Personal Data. The Company takes all appropriate measures to safeguard the confidentiality of the Subscriber’s communications and the information and data transmitted. However, the Company does not guarantee the security of data transmitted through third-party networks. The Company states that any lifting of the confidentiality of the Subscriber’s communications is permitted only insofar as it is required to fulfill its legal obligations under applicable law. Specifically, the Company shall comply, as required by law, with the content of a Prosecutorial Order, judicial, or administrative decision without prior notice to the Subscriber. 

20. The Privacy Policy is accessible to Website visitors both during their navigation of the Website and prior to the registration process for the services provided, as well as during the registration itself. It is always available on the Website’s homepage. Acknowledgement and acceptance of the Privacy Policy is a prerequisite for registration and for accessing the services offered by the Company. Modulus S.A. assumes that all users have read the Privacy Policy along with these Terms of Use.

21. Cookies. Modulus S.A. may use cookies to recognize the user. Cookies are text files stored on each user’s hard drive; they do not access any document or file from the user's computer and are used solely to facilitate the user’s access to specific services and for statistical purposes, such as identifying the areas in which the Website's services are useful or popular, or for marketing purposes. Users may configure their browser to either reject cookies altogether or accept them selectively.
